Over the last 35 years, I have been involved in several class actions and/or individual actions involving home improvement contractors, insurance companies, financial institutions, mortgage brokers, dating services, and many other entities that prey on consumers.
I am highly knowledgeable concerning loans covered by the Federal Truth-in-Lending Act (“TILA”), 15 U.S.C. Section 1601 et seq. This section allows borrowers in certain situations to cancel their loans and repay only the net amount borrowed after deducting all loan costs and monthly payments made on the loan. Borrowers must have sufficient equity in their home to obtain a new loan to payoff the balance determined after applying TILA in order to cancel their existing loans.
I also have expert knowledge of other laws which protect homeowners with problems with loans securing their homes: The Home Ownership and Equity Protection Act, 15 U.S.C. Section 1639, which contains the same protections as TILA, the California statute dealing with consumer loans secured by real property, Financial Code Section 4970, elder abuse law and other laws which protect borrowers.
